Lush Star Cars Terms & Conditions

It is the responsibility of ‘The Hirer’ to ensure that all passengers fully understand and comply with these Terms and Conditions, which supersede any previous conditions made through a verbal or written contract.

A. RESPONSIBILITY AND CONDUCT
‘The Hirer’ is liable for damages or breakages made by ‘The Hirer’ or ‘The Party’ to the interior or exterior of the vehicle. This includes incitement or behaviour that results in damage to the vehicle or its contents by a third party.

‘The Hirer’ is responsible for costs incurred by ‘The Company’ as a result of damage caused by ‘The Party’. This includes loss of business if the vehicle cannot be used until repairs are complete. ‘The Company’ may at its own discretion determine where any repairs are completed. ‘The Company’ does not accept responsibility for damage to or loss of property carried in the vehicle. The consumption of food is not permitted inside any vehicle. A stop may be pre-arranged, but must be agreed in writing during the reservation process.

Complimentary drinks supplied by ‘The Company’ may only be consumed within the vehicle. If drinks are removed from the vehicle, ‘The Company’ will recover any losses from ‘The Hirer’. Complimentary drinks must be opened by ‘The Company’, ‘The Chauffeur’ or ‘The Hirer’, at a safe distance from the vehicle to prevent damage to ‘The Hirer’, ‘The Party’ or the vehicle.

‘The Hirer’ accepts responsibility on behalf of ‘The Party’ for any loss of property provided by ‘The Company’. This includes, and is not limited to, glassware, DVD’s, videos and CD’s.

‘The Hirer’ accepts that for reasons of safety, ‘The Company’ upholds a strict No Smoking policy within all of its vehicles. Failure to adhere to this policy will result in an immediate termination of the booking. No refund will be given, and any resulting valet or damage costs will be passed to ‘The Hirer’.

‘The Company’ will terminate the booking if any passenger is found to be carrying or using an illegal substance during the hire of any vehicle. No refund will be given.

Passengers must remain seated and wear seatbelts when provided. ‘The Company’ does not tolerate shouting out of windows at other road users or pedestrians, or abuse towards ‘The Chauffeur’. Doors will be opened by ‘The Chauffeur’ and must remain closed throughout the booking. If this condition is not adhered to, ‘The Hirer’ will incur a fine.

B. SAFETY POLICY
‘The Company’ will under no circumstances exceed the legal capacity of its vehicles.

All vehicles have a luggage restriction. ‘The Hirer’ should contact ‘The Company’ if in doubt about the weight and size of their luggage, but the final decision lies with ‘The Chauffeur’. ‘The Company’ is not responsible for loss of luggage as a result of this decision.

‘The Hirer’ accepts that for reasons of safety, ‘The Company’ upholds a strict No Smoking policy within all of its vehicles. Child safety seats must be provided by the ‘Hirer’ and must comply with all government safety laws. ‘The Company’ holds all rights to check all seats before use and can refuse at any time the use of a seat before the hire commences.

C. RESERVATIONS AND BOOKINGS
You must be over 18 to make a reservation with Lush Star Cars. To make a reservation, ‘The Hirer’ must pay a deposit. This is a minimum of £50.00 and is dependent on the individual requirements of ‘The Hirer’. This deposit is non-refundable.

Full payment is required no later than four weeks before the booking. If the reservation is made within four weeks of the booking, full payment is required immediately. All outstanding accounts must be settled before the booking commences. To confirm the reservation, ‘The Hirer’ must return the contract to Lush Star Cars Head Office. The reservation may be deemed void if this contract is not returned.

‘The Company’ may at its own discretion consider a partial refund in exceptional circumstances. Claims will only be considered if made 28 days prior to the booking, or 45 days in the case of weddings. If payment has not been made by the due date, ‘The Hirer’ is in breach of contract and must pay immediately in full.

‘The Company’ may require a security payment prior to the booking date against any loss or damage sustained by ‘The Company’. ‘The Company’ reserves the right to postpone or cancel any reservation due to adverse weather or road conditions, or severe traffic congestion.

‘The Hirer’ accepts that ‘The Company’ cannot guarantee the reliability of its vehicles, the allocated time, or events out of the control of ‘The Company’ or ‘The Chauffeur’. ‘The Company’ will only honour the requirements stated in the reservation. Lush Star Cars Head Office must agree to any changes requested after the reservation has been made.

Every effort will be made to provide our film-related vehicles, but should your requested vehicle become unavailable, ‘The Company’ will provide an alternative or a full refund.

D. OTHER CHARGES
‘The Company’ is not responsible for parking charges, entrance fees, bridge tolls or congestion charges. These are not included in the agreed reservation price unless by prior arrangement, and must be paid by ‘The Hirer’ during the booking.

If ‘The Chauffeur’ is kept waiting, ‘The Hirer’ will incur a fee of £20.00 per 30 minutes over the agreed booking time. In the case of airport collections, charges will take effect after the first 30 minutes. ‘The Hirer’ accepts responsibility for parking charges.

E. VEHICLES
‘The Company’ will endeavour to supply your requested vehicle but reserves the right to change this vehicle at any time. This does not apply to film-related vehicles. If the vehicle suffers a mechanical failure or accident during the booking, ‘The Company’ will endeavour to make alternative arrangements and may at its own discretion choose the method of onward travel. ‘The Company’ is in no way liable for costs incurred by ‘The Hirer’. The size of some of our vehicles may prevent ‘The Chauffeur’ from stopping at your required destination, but we will endeavour to get ‘The Party’ as close as possible.

F. OTHER INFORMATION
‘The Company’ cannot guarantee the estimated journey time and are not liable for delays or late arrival charges incurred by ‘The Hirer’. If time and vehicle capacity permits, ‘The Chauffeur’ may be willing to collect extra passengers, with additional miles charged to ‘The Hirer’. ‘The Company’ may at its own discretion refuse any reservation without explanation. ‘The Hirer’ is responsible for providing ‘The Company’ with all the necessary and correct information. Changes may incur extra costs and should be made prior to your booking.
